United States Attorney Brendan V. Johnson announced that a Manderson, South Dakota, man has been indicted by a federal grand jury for Possession of Firearm by a Prohibited Person.
John White Plume, age 40, was indicted by a federal grand jury on May 17, 2011, for Possession of Firearm by a Prohibited Person. White Plume appeared before United States Magistrate Judge Veronica L. Duffy on November 1, 2011, and pled not guilty to the indictment. The maximum penalty upon conviction is 10 years in custody, a $250,000 fine, or both. Restitution may also be ordered.
The charge relates to White Plume’s alleged possession of a firearm following two earlier felony convictions: the first in Colorado in 1994 for Larceny and the second in South Dakota in October 2000 for Grand Theft. The charge is merely an accusation, and White Plume is presumed innocent until and unless proven guilty.
The investigation is being conducted by the Bureau of Indian Affairs, and the Oglala Sioux Tribe Department of Public Safety and the Bureau of Alcohol, Tobacco, Firearms and Explosives. Assistant United States Attorney Jay Miller is prosecuting the case.
White Plume was remanded to the custody of the United States Marshal. A trial date has not yet been set. |
